【 Terms of Service 】

When commissioning Choeurie you agree to the following Terms of Service.
Any terms that are broken will result in being blacklisted.

Agreement

  • You are of legal age.

  • You have usage rights to any reference materials or designs provided for use in the requested project.

  • You are able to provide credits for any third-party reference or designs.

  • You are responsible for understanding the usage policies and terms of services.

  • You will provide as much info as necessary regarding intended project usage and agree to discuss additional uses or changes with the Cho or their management after the project starts.


TLDR

Pre-project

  • Cho reserves the right to refuse any project.

  • Invoices are due on receipt. If payment is not received during the agreed timeframe, Choreserves the right to terminate the client's project.

  • For reference materials such as character sheets or model art provided by a third-party artist, Cho requires fully completed materials before assessing a project.

  • Written descriptions alone are not accepted for illustrations unless used for character creation. Some video references are accepted but not alone. New references will not be accepted after progress has started unless asked for by the artist.


Process

  • Work is processed in the order received + deadline, but multiple projects may be in progress simultaneously. Smaller projects may finish before bigger projects in the queue due to this.

  • Due to health, there is no definitive time frame. The time for commissions vary and are done at Cho's pace. Deadlines are always up for negotiation so that clients can expect when their commission(s) will be delivered. If the client would like to set up a deadline for their commission, please give Cho three months in advance notice.

  • If the client's deadline requires other commissions to be put on halt, a rush fee will be charged if the commission is accepted.


Revisions

  • One revision will be allotted while the client's commission is still a work in progress. Additional revisions will incur a fee (10% of the base price). After the commission is complete, Cho will not redraw/reanimate large portions (≥1/4) or make changes that were not previously discussed for free. A revision fee equivalent to the percentage changed will be charged. More information on revisions can be found here

  • "Laundry listing" does not count as 1 revision. If a document or message covering revisions is received, each listed adjustment counts as an individual revision.

  • Missing details, bugs, glitches, or clipping issues are not counted towards revisions since these would need to be fixed for the model to function properly. What counts as a revision are subjective/stylized changes that don't necessarily need to happen. Thoroughly review and consider the specific changes you would like to avoid extending beyond the original scope of a project.

  • The project's timeline will extend past the original schedule if there are large/excessive revisions.

  • After a commission is signed off as "completed" there will be a two-week revision period for any needed changes.


Payment

All payments must be made through invoices provided by VGen or Paypal to Choeurie. The first payment must be received upon delivery of the invoice within 10 days. If payment is not received, Cho reserves the right to cancel the project. A 10% non-refundable deposit is mandatory for confirmed slots on the first payment regardless of the project type. This will be deducted from the total cost of the project. This deposit covers my preparation time in the event that a client cancels. Cho can honor your deposit if a reschedule is needed. If a second reschedule is needed the slot will be forfeited and a new deposit must be paid.

  • For Live2D-related projects (model art, rigging, or model art with rigging), 40% of total project fees are due on the project start date.

  • Live2D rigging: The remaining 50% is due upon head completion.

  • Live2D model and rigging: The remaining 50% is due upon model art completion.


Refunds

  • Once work has begun on the project, Cho cannot offer a refund under normal circumstances.

  • In the event Cho or the client is unable to see out the project, the client will be offered a partial refund and deliverables based on the current completion of the project.

  • The client agrees not to file a charge-back without first contacting Cho.

  • No refunds will take place after a commission has been completed.

  • There are no full refunds under normal circumstances.


File Sharing, Redistribution, Tampering, and Licenses

Project deliverables may not be shared or resold without written consent from Choeurie. This is to keep track of the model's traffic and to know who is in possession of it. For resold assets, the new owner responsible for purchase is bound to Cho's ToS in regard to usage rights, redistribution, tampering, and credits.Live2D and illustration-related commissions may not be tampered with unless written consent is given. This includes texture atlas/art mesh adjustments if Cho is the artist of the model.By default all projects include a standard commercial license. Below are the commercial licenses I offer.

For project file access (.cmo3/.can3/.psd/etc) please inquire with Cho. These files are not given out under normal circumstances to avoid any tampering or misrepresentation of Cho's work.


Showcasing

Showcases for projects will be published 90 days after project completion.If the client uploads, publishes, or debuts during this 90-day period, a showcase will be published during/after the client’s post/debut. If 90 days have passed and the project has not been made public, a showcase will be posted at the Cho's will. If a client would like to extend this time period, inquire with Choeurie with a release date ready.If a release date is discussed, Cho has the right to post the showcase after the release date whether the client has revealed their project or not.


Termination

Choeurie reserves the right to void any given project. This will happen if the client is unable to comply with the terms of service. In the event that you have broken any rules, the client will be given a single warning. Continued offenses past this point will result in a canceled project. As stated in the Refund Policy, if a project is canceled due to misconduct Cho reserves the right to cancel the project without refund.

  • If cutting notes are disregarded multiple times in the early stages of the project, the project may be terminated early to avoid continued miscommunication with the third-party involved in the project. Since this would most likely happen early in the project a refund will be available.

  • If communication is lost multiple times during the project's timeline from the client becoming unresponsive for an extended amount of time after corresponding, the project may be terminated with no refund offered. It is the client's responsibility to reach out if they no longer have access to accounts that were previously used for communication.


【 Additional Costs 】

Heavy PSD Processing:

prep work for models that are not fully cut and cleaned.

  • Corrections are covered in L2D rigging costs for models. This does not entail cutting an illustration from scratch or heavy PSD editing.

  • Processing for uncut art starts at 100 USD. Price may adjust to the changes needed.

  • Reach out to your artist if possible before approaching for processing.

  • Applies to rigging commissions.


Correction notes*:

cutting notes for .psd files needed in order to increase the range of a model.

  • Notes are 50 USD per page

  • Clients will only be charged if the correction notes exceed the first page.

  • A PSD will be provided for more advanced cutting to prevent miscommunication.

  • Applies to rigging commissions

*If your artist is comfortable with receiving a PSD/CSP file for the notes, they will be free of charge as I can directly make notes into the model file (if the artist speaks another language I will try my best to translate but it may be a little broken).This will also be easier on the artist's end as they can skim through the file vs. reading a document that has screenshots.


Priority Fee:

skip the queue and/or acquire a commission on a short notice deadline.

  • Applicable to all commissions. One item at a time, cannot be stacked on multiple items. (eg. model art + rigging)

  • Deadlines under 2 months for illustration-based commissions are considered short notice.

  • Deadlines under 3 months for model/rig-based commissions are considered short notice.


NDA/Privacy Fee:

some/all forms of progress will not be publicized on streams/social media. the commission will be "offline".

  • Amount of privacy varies the percentage.

  • Absolute privacy is capped at 50%.

  • If the Cho is able to post and stream their work but not disclose the name and account of the client, there will be no privacy fee. However please refer to the showcase clause under the TOS. The name of the client will be disclosed after 90 days of the project finishing when displayed in the showcase.


Revision Fee:

one revision will be allotted while the client's commission is still a work in progress.*

【 FAQ 】

  • When do applications open? How do I apply to them?

Currently Cho is only taking commissions through email inquiries. Form applications will not be open for the foreseeable future.

  • Does my PSD need to be finished?

Yes (there are exceptions but an unfinished PSD will decrease your chances of being accepted). Commissions are evaluated based on the condition of the file. Layer and part setup are reviewed to better estimate rigging time and workflow for the project.

  • Is there a waitlist? Can I get on it?

No. You must wait for the application window and apply OR inquire through Rigger Mortis in order to get a slot. Inquiring through the guild does not guarantee a slot. Once my queue has been worked through slots will open shortly after.

  • What kind of applications are more likely to be accepted? What makes you choose one submission over another?

Good part separation and layer organization/labeling is very nice to work with. Other things like the freedom to post wips and stream the model also make for a more pleasant working experience. Reputable artists and artists I've previously worked with are also more likely to be accepted since I know what to expect through WOM from colleagues and previously opened communication. It is also comforting to know if the model is going to be used actively by the client! It can be saddening to see something that I've brought to life never see the light of day.

  • What does the schedule look like if I am accepted?

Slots will be queued based on the deadline of each project submitted & type. If any deadlines clash with each other projects may need to be slightly rescheduled. If this is the case affected parties will be reached out to adjust schedules. Multiple projects may be worked on simultaneously. Because of this smaller projects may finish before bigger projects in the queue.

  • Why is your TOS so long?

If there is an oddly specific clause it most likely means there has been a life experience to pair along with it. (:
